Every citizen has the constitutional right to decide for themselves how their personal data is used.
For this reason, it is our duty to protect the data you entrust to us when you visit our website. Below we would like to show you what data we have about you, what happens to this data, what security precautions we have taken to protect this data from misuse and what your rights are as a person affected by data processing.
Area of validity
This data protection declaration applies to our entire Internet presence, but not to pages of other providers for which you may find links on our pages.
Security precautions
Our in-house IT department continuously adapts the technical security precautions to the current circumstances and requirements. The integrity, confidentiality and availability of data are adequately guaranteed by technical and organizational measures.
Logging
Every time a user accesses a page on our website and every time a file is retrieved, access data about this process is stored in a log file on our server.

This data is used to generate statistics that help us to further adapt our Internet portal to your needs. We cannot derive any personal reference from this; the data will only be passed on to third parties, even in excerpts, if Controlware is legally obliged to do so.
Users have the right to request information about what personal data we have stored about them, for what purposes and over what period of time the data is processed and the legal basis for the processing. In addition, they have the right to rectification and erasure of this data as well as the right to restriction of processing and data portability.
Cookies
We use session cookies on our website. The data is not stored permanently, but is automatically deleted when the Internet browser is closed. A cookie is information that a web server sends to a browser, which the browser then sends back when this web server is accessed. Session cookies are only stored for the duration of a session. Most browsers are set to accept cookies automatically. However, you can deactivate the storage of cookies or set your browser so that it notifies you as soon as cookies are sent.
Legal basis for the processing of data when using cookies:
- The legal basis for the storage and processing of technically necessary cookies is Section 25 (2) sentence 2 of the TDDDG (Teleservices Data Protection Act). Consent is not required for this.
- For all other cookies, the legal basis for the storage and processing is your consent in accordance with Section 25 (1) TDDDG in conjunction with Art. 6 (1) sentence 1 lit. a) of the European General Data Protection Regulation (DSGVO) in conjunction with Art. 4 No. 11 and Art. 7 DSGVO. Since cookies are stored exclusively on your end device, you can delete them at any time using the corresponding function of your Internet browser. An objection is not necessary in this respect.

X Plugin
Functions of the "X" service are integrated on our pages. These functions are offered by "X" , 1355 Market Street, Suite 900, San Francisco, CA 94103, USA. By using "X" and the “Re-Tweet” function, the websites you visit are linked to your "X" account and made known to other users. Data is also transmitted to Twitter in the process. We would like to point out that, as the provider of the pages, we have no knowledge of the content of the transmitted data or its use by "X". Further information on this can be found in privacy policy at : X.com/Privacy/Policy. You can change your privacy settings on "X" in the account settings at: X.com/account/settings.
LinkedIn Plugin
Our website uses functions of the LinkedIn network. The provider is LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA.
Each time one of our pages containing LinkedIn functions is accessed, a connection to LinkedIn servers is established. LinkedIn is informed that you have visited our website with your IP address. If you click on the LinkedIn “Recommend” button and are logged into your LinkedIn account, LinkedIn is able to associate your visit to our website with you and your user account. We would like to point out that, as the provider of the pages, we have no knowledge of the content of the transmitted data or its use by LinkedIn. XING Plugin
Our website uses functions of the XING network. The provider is XING AG, Dammtorstraße 29-32, 20354 Hamburg, Germany.
Each time one of our pages containing XING functions is accessed, a connection to XING servers is established. As far as we are aware, no personal data is stored in the process. In particular, no IP addresses are stored or usage behavior evaluated. Processing of personal data
At some points on our website, we offer you the opportunity to contact us or to make use of certain services. We use the personal data transmitted in this connection only for the one purpose for which it was provided to us. Your data will not be passed on to third parties.
Security of personal data
In order to guarantee the confidentiality of communication with you, we use so-called SSL encryption. According to the current state of knowledge, the 128-bit encryption possible with this is to be regarded as secure. All browsers of the younger generation achieve this level of security. You may need to update the browser on your PC.
Changes to this data protection declaration
Due to current circumstances, such as an amendment of the European Data Protection Regulation (EU-DSGVO) or other relevant legal provisions, we will - if - necessary, update this data protection declaration.
Further legal bases for data processing
Personal data may be processed on the basis of various legal provisions, which we list below:
- If we process your personal data on the basis of your consent, this is done in accordance with Art. 6 (1) a) DSGVO in conjunction with Art. 4 No. 11 and Art. 7 DSGVO.
- Data for the initiation, implementation or termination of contractual relationships are processed on the basis of Art. 6 (1) (b) DSGVO. Data for the initiation, implementation or termination of employment relationships are excluded from this. Their processing is carried out on the basis of § 26 BDSG.
- If we process your data for the purpose of fulfilling legal obligations that affect us, e.g. from the area of tax law or social security law, this is done on the basis of Art. 6 para. 1 lit. c) DSGVO.
- Finally, we may process your personal data on the basis of an overriding legitimate interest of Controlware in consideration of your conflicting protective interests. The legal basis for this is Art. 6 para. 1 lit. f) DSGVO.
Your rights as a person affected by data processing
Information, Art. 15 DSGVO
You have the right to information about the data we have stored about you. This includes:
- the categories of personal data that are processed
- the purposes of the processing
- recipients or categories of recipients
- the planned duration of the storage of the data
- the existence of your rights to rectification, erasure, restriction of processing or to object to processing
- the right to lodge a complaint with a supervisory authority.

Please enclose a copy of your identity card showing your name, address and date of birth so that we can establish your identity and effectively prevent the transfer of data to unauthorised persons.
Correction, Art. 16 DSGVO
You have the right to request that we correct inaccurate data that we have stored about you. Furthermore, you have the right to request the completion of incomplete data records.
Deletion, Art. 17 DSGVO
You have the right to demand that we delete the data we have stored about you. This does not apply if we are legally obliged to store the data or if we need the data to fulfil contractual obligations or for legal prosecution. In these cases, the right to restriction of the processing of personal data replaces the right to deletion.
Restriction of processing, Art. 18 DSGVO
You may request the restriction of the processing of personal data concerning you by us under the following conditions:
- if you dispute the accuracy of the personal data relating to you for a period of time that allows us to verify the accuracy of the data;
- the processing is unlawful and you object to the erasure of the personal data and request instead the restriction of the use of the personal data;
- we no longer need the personal data concerned for the original purposes of the processing but you need it for the establishment, exercise or defence of legal claims; or
- if you have objected to the processing pursuant to Article 21(1) DSGVO and it has not yet been determined whether the legitimate grounds of the controller outweigh your grounds.
If the processing of personal data relating to you has been restricted, we may only process this data - apart from its storage - with your consent or for the assertion, exercise or defence of legal claims or for the protection of the rights of another natural or legal person.
If we intend to lift the restriction on the processing of your personal data, we will inform you of this in advance.
Right to data portability, Art. 20 DSGVO
You have the right to receive the personal data relating to you that you have provided to us in a structured, commonly used and machine-readable format. You also have the right to transfer this data to another controller, provided that
- the processing is based on consent pursuant to Art. 6 Para. 1 lit. a DSGVO or on a contract pursuant to Art. 6 Para. 1 lit. b DSGVO and
- the processing is carried out by us with the aid of automated procedures.
In this context, you have the right to request that we transfer the data in question directly to another controller designated by you, provided that this is technically feasible and the freedoms and rights of other persons are not affected.
Objection, Art. 21 DSGVO
You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you, provided that we process your data on the basis of Art. 6(1)(e) or (f) DSGVO.
In the event of an effective objection, we will no longer process the personal data relating to you unless we have compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing by us serves to assert, exercise or defend legal claims.
If the personal data concerning you is processed for the purpose of direct marketing, you have the right to object at any time to the processing of personal data concerning you for the purpose of such marketing; this also applies to profiling insofar as it is related to such direct marketing.
If you object to the processing for direct marketing purposes, the personal data concerning you will no longer be processed by us for these purposes.
You have the possibility, in connection with the use of information society services, notwithstanding Directive 2002/58/EC, to exercise your right to object by means of automated procedures using technical specifications.
Right to revoke your consent
If we process your personal data on the basis of your consent, Art. 6 para. 1 lit. a) DSGVO, you can revoke this consent at any time and without giving reasons with effect for the future. The consequence of a revocation may be that we can no longer provide our services to you or can only do so to a limited extent, or that certain offers can no longer be used by you.

Deletion periods
Controlware generally deletes personal data immediately when it is no longer required for the purpose for which it was collected. In some cases, however, there are legal retention periods to which we are naturally bound. In this case, the data will be deleted after the respective period has expired. Data collected through IP logging is usually deleted after 12 months.
Right of complaint
If you feel that your rights or fundamental freedoms have been violated by data processing carried out by us, you have the right to complain to our company data protection officer or a supervisory authority.
